Terms of Service

1. Acceptance of Terms

By creating an account or using the BiteBack loyalty platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Processing of your personal data is governed by the separate Privacy Policy.

2. Description of Service

BiteBack is a loyalty rewards platform that enables participating restaurants and businesses ("Partners") to offer points-based loyalty programs to their customers. The Service includes a customer-facing Progressive Web App (PWA), point accumulation, reward redemption, challenges, games, leaderboards, digital menus, group check-ins, and an optional social layer (friendships and gift points between customers).

3. Eligibility & Minimum Age

You must be at least 16 years old to register and use the Service. By registering, you represent that you meet this age requirement. If we learn that an account belongs to a minor below this age, we will delete it. Partners operating in jurisdictions with a lower digital consent age may onboard younger customers only with verified parental consent.

4. User Accounts

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information (name, phone number, and optionally email)
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

5. Loyalty Points & Rewards

Points and rewards are subject to the following conditions:

  • Points are earned through qualifying activities such as visits, purchases, games, challenges, and group check-ins as determined by each Partner
  • Points have no cash value and cannot be transferred, sold, or exchanged for money, except as gifts between friends within the Partner program where the feature is enabled
  • Partners may modify point values, reward availability, tier requirements, friendship bonuses, and gift caps at any time
  • Unredeemed rewards (vouchers) expire after 30 days unless otherwise stated

6. Acceptable Use

You agree not to:

  • Create multiple accounts to exploit promotions, rewards, challenges, referrals, or gift points
  • Use automated tools or bots to interact with the Service
  • Attempt to manipulate points, leaderboards, friendship levels, or game outcomes

7. Third-Party POS Integrations

Some Partners connect their point-of-sale (POS) systems to BiteBack. Visit and purchase data from these systems is used solely to award loyalty points and track your activity within the Partner's loyalty program. We do not share your BiteBack account data with POS providers beyond what the Partner has configured.

8. Account Deletion & Vouchers

You may request deletion of your account at any time (see the Privacy Policy for how to exercise your right to erasure). Before deletion is processed, you are given a reasonable opportunity to redeem any active vouchers. After deletion, any remaining points and unredeemed vouchers are forfeited. We may retain limited records where required by law (e.g., anti-fraud, fiscal compliance).

9. Suspension & Termination by Us

We may suspend or terminate your account if you materially violate these Terms. Where practical, we will notify you before termination and give you a chance to redeem active vouchers, unless the suspension is needed to protect the Service or other users.

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, BiteBack and its Partners shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid to use the Service (which is zero for free customer accounts). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, death or personal injury caused by negligence, fraud, or statutory liability under data-protection law.

11. Partner Admin Misuse Disclaimer

BiteBack is not responsible for how Partners or their staff members use customer data accessible through the admin panel. Partners act as Data Controllers under the GDPR and are solely responsible for the lawful use, security, and confidentiality of customer data. BiteBack shall not be liable for any misuse, unauthorized access, data breaches, or violations of data protection laws resulting from Partner actions, including but not limited to: unauthorized sharing of customer data, failure to protect customer information, or violations of customer privacy. Partners assume full responsibility for their admin users' actions and must implement appropriate access controls and staff training.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Disputes shall be submitted to the competent courts of the Partner's registered seat, unless a mandatory consumer-protection law grants you the right to bring proceedings in your country of residence. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via the app or email and, where required, request fresh acceptance before you can continue using the Service. Continued use of the Service after non-material changes are posted constitutes acceptance of the updated Terms.
